TERMS AND CONDITIONS
1. This is an agreement between the user (the individual who accepts the terms and conditions of the agreement and makes use of the 60seconds service, hereinafter referred to as “the user”) and 60seconds (hereinafter referred to as “60seconds” and “the service”). 2. The user accepts these terms and conditions and agrees to be unconditionally bound by them during use of the site as well as thereafter in perpetuity. The user specifically acknowledges that he/she has read these terms and conditions. Where the user is acting on behalf of an entity or legal persona other than himself/herself, he/she acknowledges that he/she binds such entity to the same terms and conditions. 3. The user agrees that 60seconds accepts no liability whatsoever for any damage, virus, software malfunction, hardware malfunction or technical problem of malfunction that may occur with the user’s computer system during or subsequent to usage of the service. 4. While 60seconds will make all reasonable efforts to ensure that the user’s information is correctly displayed, 60seconds will not accept any responsibility for the incorrect, incomplete or late display of any information. The user is responsible to notify 60seconds of any incorrect, incomplete or late display of information. 5. The user grants 60seconds the specific authority to allow their profile and all supplied information to be viewed and seen by the funders, financial services companies and financial partners of the service (hereinafter referred to as “the funders”), in part or in whole, at such time and in such manner as 60seconds may determine. 6. 60seconds makes no undertaking or warranty, implied or explicit, in connection with usage of the service, or that use of the service shall result in the user being approached by a funder, or that usage of the service shall result in receiving any form of business funding. 7. The user specifically indemnifies 60seconds against any claim, of whatever nature, that may arise as a result of any person viewing or seeing the user’s information on the site. 8. The user further warrants that all information, photographs and material (“the content”)provided to the service to promote the user’s business or list it on the service, is correct and true, and that the user has unfettered rights to such content; the user does now indemnify the service against any such claim, and in the event of any claim against the service arising out of the service’s carrying of such content, the user who provided such content shall automatically accept and assume full liability and responsibility for such claim. 8. The user agrees and accepts that 60seconds is not providing any form of financial, business, investment or legal advice, and that participation on the site and use of the service is merely a promotional mechanism to expose and advertise the user’s business. 9. The user specifically acknowledges that the service provides a method of introduction between funders and users, and any dealings, discussions, negotiations or business contracts between a user and a funder shall be a matter solely between those two parties, in which the service shall not at any time be a party. 10. Any contact, communication, negotiation, business agreement, funding or investment agreement, loan, shareholders’ agreement or any other business discussion or contractual negotiation or relationship between the user and any funder, howsoever it comes into being or commences, and irrespective of the outcome, shall be a matter solely between those two parties and the service accepts no responsibility or liability for the conduct, conclusion or validity of any agreement between a user and a funder. 11. The service reserves the right to amend, revise or alter these terms and conditions at any time, including after their acceptance by a user; any such amendment shall be notified to the user who may elect to accept or reject such amendment; in the case of non-acceptance, the service shall have the right to suspend or terminate the user’s access to and use of the service. 12. The service reserves the right at all times to accept, or refuse to accept, any user and any content from the user, and in the case of non-acceptance the service shall not be obliged to furnish any reasons for such non-acceptance. 13. By clicking on the “accept terms and conditions” option on the service, the user unconditionally accepts these terms and conditions in their entirety without abrogation or exception. |
